Terms and Conditions

By registering for and using ConsentMD Pulse CRM, you agree to comply with these Terms and Conditions governing authorized use of the platform.

Acceptance of Terms

By creating an account or accessing ConsentMD Pulse CRM, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree, you must not use the System.

Purpose of the System

ConsentMD Pulse CRM is designed to assist organizations in managing customer relationships, referral leads, referral sources, visit tracking, communications, and operational workflows. The System is intended for authorized business use only.

User Responsibilities

You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the confidentiality of your login credentials.
  • Be fully responsible for all activities conducted under your account.
  • Use the System only for lawful and authorized business purposes.
  • Ensure that all data entered into the System is collected, processed, and shared in compliance with applicable privacy and data protection laws.
  • Immediately notify the administrator of any unauthorized use or suspected security incident.

You must not:

  • Attempt to gain unauthorized access to the System, servers, or related infrastructure.
  • Interfere with or disrupt the integrity or performance of the System.
  • Upload harmful code, malware, or any material intended to damage or compromise the platform.
  • Use the System to store or transmit unlawful, infringing, or abusive content.

Data Privacy and Security

We implement reasonable administrative, technical, and organizational safeguards designed to protect data against unauthorized access, loss, misuse, or alteration. These include controlled access, system monitoring, and secure hosting environments.

However, you acknowledge that:

  • No system can be guaranteed to be 100% secure.
  • You are responsible for maintaining the security of your own devices, passwords, and internal access controls.
  • You must ensure that proper consent has been obtained from individuals whose data is entered into the CRM.

Security Incidents and Breach Handling

In the event of a suspected or confirmed security breach:

  • We will take reasonable steps to investigate, contain, and mitigate the incident.
  • Access to affected accounts or features may be temporarily suspended to prevent further risk.
  • We will notify affected parties when required by applicable law or when deemed reasonably necessary.
  • Users agree to cooperate with any investigation, including updating credentials or limiting access if requested.

ConsentMD Pulse CRM shall not be held responsible for breaches caused by:

  • Weak or shared user passwords.
  • Unauthorized access resulting from user negligence.
  • Third-party systems, integrations, or services outside our control.
  • Actions taken by individuals granted legitimate access by the user's organization.

Ownership of Data

  • All client or business data entered into ConsentMD Pulse CRM remains the property of your organization.
  • The platform, including its software, design, database structure, and technology, remains the intellectual property of ConsentMD and its licensors.
  • You are solely responsible for the legality, accuracy, and integrity of the data you store.

Account Access, Monitoring, and Termination

We reserve the right to:

  • Suspend, restrict, or terminate access if these Terms are violated or if suspicious activity is detected.
  • Monitor system usage to maintain security, performance, and compliance.
  • Remove inactive, unauthorized, or high-risk accounts.
  • Enforce password resets or security updates when necessary.

Users may request account deactivation by contacting the system administrator.

System Availability and Backups

We strive to maintain reliable service but do not guarantee uninterrupted availability. Temporary downtime may occur due to:

  • Scheduled maintenance or upgrades
  • Security enhancements or emergency patches
  • Network or infrastructure issues beyond our control

Users are responsible for maintaining their own operational backups or exports of critical data when required for business continuity.

Limitation of Liability

To the fullest extent permitted by law, ConsentMD Pulse CRM shall not be liable for:

  • Any indirect, incidental, special, or consequential damages.
  • Loss of business, revenue, or data resulting from use of the System.
  • Security incidents arising from user misuse, misconfiguration, or third-party integrations.
  • Events beyond reasonable control, including cyberattacks, force majeure, or infrastructure failures.

Use of the System is at your own risk.

Indemnification

You agree to indemnify and hold harmless ConsentMD, its owners, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your misuse of the System
  • Your violation of applicable laws or regulations
  • Data entered without proper authorization or consent
  • Breaches caused by your organization's internal practices

Updates to Terms

We may modify these Terms from time to time to reflect legal, technical, or operational changes. Continued use of the System after updates constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and interpreted in accordance with applicable laws and regulations in the jurisdiction where the service is operated.
